I. REPRESENTATIONS AND WARRANTIES
A The Corporation offers a unique and innovative approach to medical education as a National Board Examination Preparation and Review Course for Physician Assistants, hereinafter referred to as The Course, that is a directed study, self-instructional, self-paced, self-evaluational, and conducted entirely via a secure interactive internet website.
B. The Corporation hereby agrees to provide access to The Course to The Client to assist The Client in their study and preparation for taking the Physician Assistant National Certification Examination (PANCE), hereinafter referred to as “The Boards” offered by the National Commission on the Certification of Physician Assistants (N.C.C.P.A.).
C. In order to participate in The Course, The Client agrees to pay The Corporation two hundred fifty dollars ($250), which includes a non-refundable course registration fee of fifty dollars ($50) and a course tuition fee of two hundred dollars ($200). The Client agrees to pay The Corporation in full for The Course prior to being granted access to participation.
II. TUITION REFUND GUARANTEE POLICY
A. The Corporation guarantees that The Client will pass The Boards if The Client completes all of the requirements of The Course. Should The Client complete The Course and not pass The Boards, The Client may be entitled to a full tuition refund or to repeat The Course for no additional cost.
B. There shall be no refund of the non-refundable fifty dollar ($50) course registration fee.
C. The tuition refund guarantee is subject to the following terms and conditions:
1. The Client must have paid for The Course personally and not be part of a group payment plan
2. The Client must have completed all of the requirements of The Course including:
- Submitting the required number of expanded SOAP notes
- Passing the required number of quizzes
- Passing at least three of the multiple choice examinations
3. The Client must request a tuition refund in writing within thirty (30) days after being notified by the N.C.C.P.A. of failure to pass The Boards.
4. The Client shall provide The Corporation with a copy of the supporting documentation of failure of The Boards furnished by the N.C.C.P.A. along with the written refund request.
D. Upon full compliance with the above terms and conditions, The Corporation will refund the tuition payment to The Client within ninety (90) days following the receipt of the refund request.
E. Should the Client elect to matriculate through the "Test Only"
portion of the MEDEX Enterprises Board Review Course and not complete
the required 100 expanded SOAP notes, it shall be understood that the
Client shall forfeit all rights to the tuition refund guarantee.
III. REPEAT COURSE POLICY
A. The Corporation guarantees that The Client will pass The Boards if The Client completes all of the requirements of The Course. Should The Client complete The Course and not pass The Boards, The Client may be entitled to a full tuition refund or to repeat The Course for no additional cost.
B. The terms and conditions for repeating The Course after failure to pass The Boards are essentially the same as the tuition refund guarantee policy except that The Client is not disqualified for being part of a group payment plan.
C. Additionally, there is more direction given in the selection of the expanded SOAP note written assignments and a closer monitoring of the quiz performance evaluations.
IV. COURSE INFORMATION AND MATERIALS
A. The Corporation grants to The Client a time limited license permitting the use of The Course for the express and sole purpose of assisting that one individual to study and prepare for The Boards.
B. The Corporation does not license or grant The Client any right to save, download, print, copy, duplicate, or reproduce any of the information or materials presented in The Course.
C. There is no license granted or implied by The Corporation that would allow The Client to share, distribute, disseminate, or manufacture any part of The Course including its design and programming.
D. The Client agrees and acknowledges that all of The Course information and materials are the sole and exclusive property of The Corporation.
V. RESERVED RIGHTS
A. The Corporations reserves the right to terminate access and block The Client from participation in The Course for cause including but not limited to:
- application fraud
- identity misrepresentation
- obscene data entries
- misuse of virtual classroom
- any attempt to save, download, print or copy materials
- allowing multiple users on this individual use license
- dissemination, distribution, or duplication
- any data security violation of H.I.P.A.A. guidelines (Health Insurance Portability and Accountability Act of 1996)
- use of The Course website for any illegal activity
B. If for any reason The Client is barred from participation in The Course by The Corporation, The Client shall forfeit all fees paid to The Corporation and shall make void the tuition refund be guarantee and The Client shall not be allowed to repeat The Course.
C. The Corporation reserves the right to pursue legal action against The Client for violation of this agreement.
D. Notwithstanding where executed, this contract shall be interpreted in accordance with the Laws of the State of Nevada.
VI. ACCEPTANCE
By agreeing to this contractual document, The Client represents that he or she has read the above contract and is in agreement with the terms and conditions and agrees to abide by same. |
